Terms & Conditions

The sale of merchandise and/or services described herein are made solely and fully subject to and conditional upon your acceptance to the Terms and Conditions contained on the back of this estimate/invoice.

Wise Flooring and Design Corp. (“Wise”) sells to you (“Customer”) the merchandise and/or services described herein only upon your acceptance of these terms and conditions. By signing below or taking receipt of seller’s merchandise or accepting the services, you agree to be bound by these terms.

Installation: To ensure quality installation of your new flooring, in all affected areas Customer must: 1) remove all furniture and appliances, unless this service has been paid for 2) have ambient interior temperature at least 68-74 degrees for 24 hours prior and during the installation, 3) For wood surfaces, relative humidity levels must be 35-45% prior, during, and after wood installation 4) all doors must be removed (if too tall to replace after new flooring, it is customer’s responsibility to shorten), 5) all existing flooring removed leaving a smooth, clean surface for installation, 6) existing tack strip for carpeted areas should remain in place, 7) any new paint or wallpaper must be installed 72 hours prior to flooring install, unless painting after flooring completed, 8) Customer or Customer’s agent must be 18 years or older and on site during the installation, unless prior arrangements have been made with Wise 9) during installation, the area(s) should be free of any other persons or trades.

Limited Lifetime Warranty: Your new flooring includes a limited warranty against defects in installation (e.g. untucked carpet or opening seams) (“Warranty”) as per manufacturer's specified warranty duration and inclusions. There is a one-year installation warranty on all flooring, unless otherwise provided in writing by Wise. This warranty is non-transferrable, non-assignable, and is only valid in residential homes with only standard residential use. Warranty applies only to carpets installed over new padding. Warranty expressly excludes any and all incidental, consequential, or special damages regardless of the customer's theory of recovery. Warranty applies only when the flooring is used consistent with manufacturer’s specification and guidelines. Warranty term is limited only to the term of customer’s ownership of the primary property where the merchandise is installed. Warranty will only be in effect if the project is paid for in full.

Financial Terms: All amounts are due in full upon substantial completion of flooring installation. All outstanding balances accrue interest at the rate of 2% per month from the due date. Customer agrees to pay for all costs and expenses incurred to collect Customer’s balance, including attorney fees. If a customer order is cancelled by the customer, the customer will pay a restocking fee of 45% plus any applicable shipping and freight charges. All products are non-returnable unless approved in writing by Wise Flooring & Design management. If approved, any unused merchandise must be returned within 30 days from the date of sale and must be in the original package and factory new condition. Wise may cancel any order for any reason upon notice to Customer with fee or liability. If the customer is an entity, then the agent entering into this agreement on behalf of the entity agrees to personally liable for all amounts outstanding for him or herself or on behalf of the entity principals as the case may be. Customer assumes all responsibility for lost, stolen, or damaged merchandise once delivered to Customer, whether or not yet installed.

General Terms: These Terms and Conditions represent the entire agreement of the parties and supersedes all prior negotiations and agreements between the parties related to the subject hereof. No other agreements no included herein apply to the sale of the merchandise. The parties waive their right to a trial by jury. Under no circumstance shall Wise be liable for incidental, consequential, special, punitive, or indirect damages to Customer. All labor and merchandise provided will be to industry standards and in new /unused condition and quality. Customer waives claims of damages or negligence related to the performance and installation of the work described incidental to normal construction processes (e.g. dents’ scratches, gouges to walls, dings on baseboard/trim, cabinets, fixtures, and appliances). Wise is not liable for latent defects, unforeseen conditions or naturally-occurring defects, flaws, imperfections common to natural products. All timeframe and dates provided to Customer are estimates only. Wise cannot be liable for any delay in the sale or installation of merchandise. The customer is responsible for the cost and acquisition of all required government permits related to the installation.
